Hakaya Terms of Use.

Agreement

These Terms of Use govern your access to and use of Hakaya, including the mobile app, website, story features, generated media features, credits, subscriptions, support channels, and related services. By using Hakaya, you agree to these terms.

If you download Hakaya from the Apple App Store, Apple's Standard End User License Agreement applies to the licensed app unless Hakaya provides a separate custom EULA through Apple. If you download Hakaya from Google Play, these Terms apply together with Google Play's applicable terms. If these Terms conflict with mandatory app store terms, the app store terms control only to the extent required by that store.

Eligibility and accounts

• You must be old enough to use online services under the laws that apply to you.
• You are responsible for the activity that happens through your account.
• You must provide accurate account information and keep your sign-in method secure.
• You may not use Hakaya if you are legally barred from receiving or using the service.

License to use Hakaya

Hakaya grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the app and website for your own lawful personal use. You may not copy, modify, reverse engineer, resell, sublicense, or misuse Hakaya except where applicable law gives you a right that cannot be waived.

Stories and user content

You keep the rights you have in sentences, story ideas, prompts, names, comments, and other content you submit to Hakaya. You give Hakaya a license to host, store, process, display, reproduce, modify for formatting, generate related media from, create exports from, and share your submitted content as needed to operate, improve, protect, and support Hakaya.

Hakaya is collaborative. When you submit a sentence or scene to a shared story, other story participants may continue to access that submitted content according to the story settings. If your account is deleted, submitted shared story content may remain with your identity removed unless removal is required or approved for privacy, safety, legal, or policy reasons.

User content, moderation, and reports

Hakaya includes user-generated content. You may not submit, invite others into, generate, export, or share content that is illegal, abusive, hateful, sexually exploitative, harassing, threatening, deceptive, infringing, invasive of privacy, or otherwise harmful. You also may not use Hakaya to target, shame, or exploit another person.

Hakaya may review, restrict, hide, remove, redact, or preserve content when needed to operate the service, enforce these Terms, protect users, respond to reports, comply with law, or handle privacy, safety, legal, or policy requests. Reports can be sent through Support. Valid cases may be redacted with a tombstone or handled through an administrative review workflow.

If another user is bothering you, do not continue the interaction. The current reporting path is Hakaya Support. Hakaya may limit or suspend accounts, remove access, or take other action when we believe it is needed to protect users or the service.

AI-generated content

Hakaya may let you generate images or videos from story scenes, prompts, styles, and related context. Generated media may be imperfect, unexpected, or similar to content generated for other users. You are responsible for reviewing generated media before sharing it and for using it in a lawful, respectful way.

Do not use Hakaya to generate or share illegal, abusive, hateful, sexually exploitative, harassing, deceptive, infringing, or otherwise harmful content. Hakaya may restrict, remove, or refuse content or generations that appear to violate these terms or platform rules.

If AI-generated content appears offensive, unsafe, infringing, or otherwise inappropriate, report it through Support. Hakaya may remove generated media, block access to it, refund or adjust credits where appropriate, or take other action after review.

Credits, purchases, and subscriptions

Hakaya may offer credits, paid features, or subscriptions such as Hakaya Plus. Prices, renewal periods, included benefits, and cancellation options are shown in the app or app store purchase flow before you buy. Hakaya Plus is a monthly auto-renewing subscription unless the purchase screen says otherwise. Subscription benefits may include preserving archived stories and generated story images or videos beyond the free retention period and maintaining access to stories you participated in.

Subscriptions renew automatically unless canceled through the store account that manages the subscription. You can manage or cancel Hakaya Plus through your Apple App Store or Google Play account settings. Cancel at least 24 hours before renewal to avoid the next charge. If you cancel, access continues until the end of the current paid period unless the store or applicable law provides otherwise.

Digital credits and generated-media purchases are used for app features and do not represent cash, currency, or stored value. Unless required by law or app store policy, credits, used generations, and partially used subscription periods are not refundable through Hakaya. Store-managed purchases are also subject to the refund rules of Apple, Google, or the applicable payment provider.

Credits may be consumed when you request optional generated media or story exports. Generation attempts may fail because of provider errors, safety review, timeout, connectivity, unsupported content, or other technical reasons. Hakaya may refund or adjust credits for failed generations according to the app's generation and billing logic.

Acceptable use

• Do not harass, threaten, abuse, impersonate, or exploit other people.
• Do not upload or generate content that is illegal, hateful, sexually exploitative, or violent toward protected groups.
• Do not infringe someone else's intellectual property, privacy, publicity, or other rights.
• Do not interfere with Hakaya's security, infrastructure, billing, moderation, or normal operation.
• Do not scrape, automate, reverse engineer, or resell Hakaya without written permission.

Intellectual property and copyright complaints

Hakaya, the app design, brand, software, and service features are owned by Hakaya or its licensors. These Terms do not transfer ownership of Hakaya's intellectual property to you.

If you believe content in Hakaya infringes your copyright, trademark, privacy, publicity, or other rights, contact Support with enough information to identify the content, your rights, and how we can reach you. Hakaya may remove or restrict content after review.

Deletion, expiry, and support requests

You can delete your account from the app. Account deletion removes private account data and signs you out, but submitted collaborative content may remain anonymized as described above. Story and generated-media expiry rules are described in Hakaya's delete and expiry policies.

If you cannot access the in-app deletion flow, contact Support and request account deletion assistance. Privacy, legal, safety, or sensitive-content removal requests can also be sent to Support. Valid requests may be reviewed and handled through an administrative workflow.

Suspension and termination

Hakaya may suspend, restrict, or terminate access to the app, stories, media, credits, subscriptions, or accounts if we believe you violated these Terms, created risk for other users, abused billing or support systems, infringed rights, or used Hakaya in an unlawful or harmful way. We may also remove or preserve content as needed for safety, legal, retention, moderation, or support reasons.

App stores

Apple and Google are not responsible for providing Hakaya support or maintenance, except as required by applicable store terms. If a third party claims that Hakaya or your use of Hakaya infringes intellectual property rights, Hakaya will be responsible for investigating and resolving that claim to the extent required by these terms and applicable law.

Apple and its subsidiaries are third-party beneficiaries of Apple's Standard End User License Agreement for App Store downloads and may enforce that agreement as allowed by Apple. Google Play purchases and subscriptions are also subject to Google Play's applicable terms and policies.

Service changes and availability

Hakaya may change, suspend, or discontinue features, styles, generation options, credits, pricing, or availability. We try to keep Hakaya reliable, but online services and AI generation systems may be interrupted, delayed, unavailable, or produce failed results.

Disclaimers and limits

Hakaya is provided "as is" and "as available." To the maximum extent permitted by law, Hakaya disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted service, and error-free operation.

To the maximum extent permitted by law, Hakaya will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost content, or loss of goodwill. Some jurisdictions do not allow certain exclusions or limits, so some of these limits may not apply to you.

Changes to these terms

Hakaya may update these terms as the app changes. If changes are significant, we will provide notice in the app, on the website, or through another reasonable channel. Continued use of Hakaya after the updated terms take effect means you accept the updated terms.
